01The agreement
These terms are a contract between you and Forgutti Unipessoal Lda (NIF 519031075), which operates Vessero ("we" and "us"). They cover selling in the Vessero Creator Store: opening a shop, listing products, and being paid for what sells.
You accept them when you tick the box to open your shop, which records the date and the version you accepted. When we change them we ask you to accept the new version before you send anything else for review; products already on sale keep selling meanwhile. Your use of Vessero itself stays under the Terms of Service.
02How selling works
You give us a non-exclusive licence to show, sell and deliver your product to buyers, and to make the copies delivery needs (a buyer's own board, character, folder or download). We sell it in our own name: we take the payment, charge any VAT or sales tax, and issue the buyer's receipt and invoice. You keep everything else you own in it.
Every sale and every free claim happens on Vessero. A listing may not send buyers to pay anywhere else, ask for contact details to sell outside the store, or carry payment links. A buyer's licence is the one shown on the product's page: they may use what they bought in their own and their clients' work, and may not resell it.
03Prices and our fee
You set the price in US dollars, including tax, from $1.99 to $500.00, or free. A price change takes effect at once, without review; people who already bought keep what they paid for.
On each paid sale our fee is 10% + $0.50, worked out on the price after VAT or sales tax. Card, tax and invoice costs come out of our fee, not your share. Free products pay nothing. Courses and memberships sold through a community pay the fee in the Community Terms instead.
04Being paid
Your share of each sale is held for 30 days, for refunds and chargebacks. Once that has passed it is paid in the monthly run, from the 3rd day of each month, when you are owed at least $50.00 ($100.00 for a US dollar SWIFT transfer). Less carries over to the next month.
Depending on your country we pay through Stripe, Wise or PayPal, to an account in your own name or your business's name only. Stripe and Wise keep your bank details; we keep their masked summary. After you change your payout details, payouts pause for 7 days and we email your account address. A Wise or PayPal transfer fee comes out of what arrives. We do not pay to countries under sanctions.
You are responsible for your own income taxes. Where the law requires us to report what we pay you (for example under the EU's DAC7 rules), you must give us the details it asks for, and we may hold payouts until you do.
05Refunds and chargebacks
Sales are not refundable for the buyer, except where the law where they live says otherwise, or when something they bought will not download or open, or they were charged twice. Only we refund. A full refund or a lost chargeback ends the buyer's licence: downloads and prompts stop, a bought character is hidden and bought pictures leave their uploads. A bought board stays, because it holds the buyer's own work.
A refund or chargeback before your share is paid takes it back from the sale. After it is paid, the amount is taken from what you are owed next, and your balance may go below zero until later sales cover it. A dispute we win puts your share back.
06Review
Every product, and every change to one, is checked automatically and then read by our team before it goes on sale. We approve it, ask for changes, or refuse it, and tell you why with the clause of these terms it rests on. A product on sale keeps selling while an edit is reviewed.
07Only your own work
You may only sell what you made and have every right to sell: no one else's prompts, pictures, characters, boards or files, and nothing you bought in the Creator Store. A product may not use another company's brand, logo or characters, or copy another seller's product. You confirm this each time you send a product.
08Real people
Characters must be synthetic. A product may not show, copy or imitate a real person's face, body or voice, or use a voice cloned from a recording. A character comes with a library voice only.
09Minors
Nothing that shows, or could be read as, someone under 18 in a sexual or suggestive way, ever. Characters must read as adults. We remove such a product at once, end every buyer's access, close the shop and report it where the law requires.
10Sexual content
No nudity or sexual content. Lingerie and swimwear shown as they would be in a mainstream fashion campaign are allowed.
11Harm
No hate, harassment, graphic violence or gore, nothing that encourages self-harm, and nothing made to get round Vessero's or another service's safety checks.
12Fraud
No kits for deceiving people: fake documents, receipts, reviews or IDs, impersonation, phishing pages, or scams.
13Personal data
A product may not carry anyone's personal data: names with contact details, addresses, phone numbers, accounts or anything that identifies a private person.
14Files
Files must be what their names say. Programs, installers, scripts, plugins that load code and web pages are not sold. A zip may be sold when nothing inside it is one of those, another kind of archive, or locked with a password: we open every zip, and the zips inside it, to check. A PDF that runs code, opens other programs or hides files inside it is refused. We may rewrite a PDF to clean it before it goes on sale. Private links may only point to the services the editor lists, and are shown only to buyers.
15Saying what it is
A product's title, words and pictures must say truly what the buyer gets and what it does. No promises of results it cannot keep, and no product that is not what its page says.
16Examples made here
Examples of what a prompt or a board makes must have been made on Vessero, so buyers see what they will get here.
17Quality and spam
A product must be worth buying on its own: no near-copies of your other products, filler, or many products made to crowd the store.
18Reports, takedowns and strikes
Anyone may report a product, a shop or a rating. A report about minors, or reports from three people who bought it, pause a product until we have looked.
We may remove a product that breaks these terms. For illegal content, harmful files, fraud and valid rights notices, removing it also ends every buyer's access; otherwise buyers keep what they bought. A removal for a serious breach is a strike. 3 strikes within 180 days suspend your selling for 30 days; a second suspension is permanent. While suspended, your buyers keep their access and your payouts are held.
You may appeal each decision once, from the product in My products. A different member of our team decides the appeal.
19Closing your shop
You may pause or remove your products, or close your shop, at any time. Buyers keep what they already bought, and we still pay you what you are owed once its hold has passed. If you delete your account, the same applies: your shop shows as closed. We may close a shop that breaks these terms seriously or repeatedly.
20Responsibility
You are responsible for your products and for the claims anyone makes because of them, and you will cover our costs from a claim caused by your breach of these terms. Our responsibility to you is limited as in the Terms of Service.
21General
These terms are governed by the laws of Portugal, and any dispute goes to the courts of Portugal. Questions go to support@team.vessero.com.
